The plaintiff, Kitchen, seeks recovery of damages alleged as the result of the negligent operation of one of the street cars of defendant railway company. Trial proceeded in the superior court for Pierce county, sitting with a jury. At the conclusion of the evidence introduced in behalf of Kitchen, and also at the conclusion of all of the evidence introduced in behalf of both parties, counsel for the railway company, by appropriate motions, challenged the sufficiency of the evidence to sustain any recovery by Kitchen.
