Plaintiffs in error, Frank C. Gierens and Nicholas J. Eerencak, were convicted in the circuit court of Carroll County for the larceny of $29.45. Each was sentenced to the penitentiary for a term of not less than two nor more than four years. They sued a writ of error out of this court to review the record of their convictions.
