The defendant in error will be referred to herein as plaintiff, and plaintiff in error as defendant, as they appeared in the trial court.

The plaintiff filed his petition in the superior court of Pottawatomie county on August 15', 1933. Embraced therein are two causes of action. In the first cause of action it is charged that the plaintiff sustained damage by destruction of his crops on a farm on Little river in the year 1932, because of the negligence and carelessness of the defendant in construction, operation, and maintenance of its railway across Little river bottom near the land plaintiff…
