KNOX, District Judge.

This suit, based upon the laws of the United States, 12 U.S.C.A. § 264(j) paragraph 4th, grows out of the liquidation of the assets of the Fort Greene National Bank of Brooklyn, New York (hereinafter referred to as the Bank), and of which, upon *179the Bank’s failure, the plaintiff, Federal Deposit Insurance Corporation (hereinafter referred to as F. D. I. C.), became receiver. Jurisdiction is predicated, also, upon the fact that the United States is the owner of more than one-half of the capital stock of the F. D. I. C. 28 U.S.C.A. § 42.
