Tried before a general court-martial of officer and enlisted members, the appellant was charged with an attempt to murder with premeditation, conspiracy to murder with premeditation, conspiracy to commit an aggravated assault, aggravated assault, and wrongful discharge of a firearm, in violation of Articles 80, 81, 128, and 134, Uniform Code of Military Justice, 10 U.S.C. §§ 880, 881, 928, and 934 (1994)[hereinafter UCMJ], respectively.
