OPINION
WALKER, District Judge:
INTRODUCTION
Appellant creditor David D. Berdon, as Trustee for a group including Debtor’s transferor, (“Berdon”) appeals from an Order of the Honorable Howard C. Buschman III, Bankruptcy Judge. The Order denied Berdon’s motion for approval of a Stipulation in which Cobham Enterprises, Inc. (“Debtor” or “Cobham”) agreed to surrender possession of leased premises located at 254 West 54th Street, New York, New York, to Berdon.
