MEMORANDUM OPINION AND ORDER

DE MENT, District Judge.

Before the court are two motions to dismiss, filed by both Defendants sepa rately on September 12, 2000. Plaintiffs responded on September 27, 2000. After careful consideration of the arguments of the parties, relevant law, and the record as a whole, the court finds that the motions are due to be granted in part and denied in part.
