The record discloses that the judgment which was sought to be vacated in this ease was rendered on January 30, 1902, and the motion to vacate said judgment was made on November 30, 1902, on the ground that the court had no jurisdiction to render judgment against the plaintiff in error. The court declined to sustain the motion, on the supposed ground that he had no jurisdiction to hear and determine the same.
