LIPPINCOTT, J.,

Plaintiff, a real estate broker, seeks specific performance of an agreement of sale entered into by him personally with defendant’s decedent immediately after the property was listed with plaintiff by decedent for sale. The chancellor filed an adjudication and decree nisi in favor of plaintiff, and defendant’s exceptions thereto have been argued before the court en banc.
