12Plaintiff appeals from a judgment of the trial court dismissing her petition with prejudice. We reverse and remand for the reasons which follow.

On July 21, 2008, plaintiff Lori Bordelon Mascaro filed the instant lawsuit against the Parish of Jefferson1 seeking damages for injuries sustained in a trip and fall on a parish sidewalk. Defendants answered the petition, and forwarded certain discovery requests to plaintiff on February 9, 2009.
