The appellant, as plaintiff, sued the appellee and others in the county court of Dallas county. The defendant filed his plea of privilege' to be sued in Col-lingsworth county, the county of his residence. The plaintiff in that suit then filed his controverting affidavit to such plea. The judgment rendered in that case upon such plea and upon the merits is not disclosed by the record, except by inference to be drawn from the fact that this suit is brought to restrain the filing and recording of an abstract of judgment issued out of said county court.
