Action by appellee for damages for personal injuries. The suit was brought in the Hancock Circuit Court, and the venue changed to the Henry Circuit Court.

It is first claimed by appellee that the pleadings are not properly in the record. The caption of the transcript of the clerk of the last-named court recites that on. a day named there was filed in his office “the following transcript from the clerk of the Hancock Circuit Court, in these words, to Wit.”' This is followed by the transcript of that clerk containing what purports to be a transcript of the proceedings in that court, and also the…
