KAUFMAN, J.

Defendant Walter Stephen Scott appeals from a judgment of conviction of two counts of attempted unlawful driving or taking of a vehicle (Pen. Code, § 664, Veh. Code, § 10851).

By information defendant was charged with one count of attempted robbery and two counts of attempted unlawful driving or taking of a vehicle. He pleaded not guilty and not guilty by reason of insanity to all counts, waived jury trial and stipulated to trial by the court as to both guilt and sanity.
