This is an appeal from a judgment declaring that ch. 38, Laws of 1979, is invalid as to plain tiffs because it impairs the retirement contract of each plaintiff and deprives each plaintiff of property without due process of law. The plaintiffs-respondents are judges, either of the Wisconsin Court of Appeals or the Circuit Court for Milwaukee County. Chapter 38, Laws of 1979 (which created secs. 40.90-96, Stats. 1979-80), reduces the salary payable to each plaintiff for current service to the State of Wisconsin by an amount equal to the full pension benefit each currently receives from the…
