The plaintiff, Richard J. Casey (plaintiff), appeals the dismissal of his claim of age discrimination on a motion for summary judgment brought by the defendants, Town of Portsmouth (town) and Donna A. Barker (Barker), individually and in her capacity as town personnel director (collectively defendants). The plaintiffs complaint alleged that the defendants discriminated against him based on his age by twice failing to hire him for the position of utilityman in 1998.
