HOWE, Justice:

This is a case of first impression, being the first appeal of a conviction under the Utah Racketeering Influences and Criminal Enterprise Act, 1 Utah Code Ann. §§ 76-10-1601 to -1609 (1978, Supp.1986), sometimes referred to as RICE. Defendant Richard McGrath was charged by a Weber County grand jury in nine separate indictments with eight counts of distribution of a con trolled substance for value, in violation of Utah Code Ann. § 58-37-8(l)(a)(ii) (1986), and one count of racketeering, in violation of section 76-10-1603.
