Appeal from a judgment of the County Court of Greene County (Lalor, J.), rendered September 28, 2004, (1) upon a verdict convicting defendant of the crimes of criminal possession of a controlled substance in the fourth degree and criminal possession of a controlled substance in the third degree, and (2) convicting defendant upon his plea of guilty of the crime of criminal possession of marihuana in the fifth degree.
