This action was brought by plaintiff for himself and wife to recover for the death of their nine year old son, Barney Zimmerman, whose death, plaintiff alleged, resulted from the concurring negligence of a truck driver employed by Lawrence Berry, and a bus driver employed by Houston Transit Company. Said employers were made defendants to plaintiff’s action, and Lawrence Berry was made a cross-defendant to a cross-action filed by Houston-Transit Company.
