1Opinion of the CourtGantt, J.
On the 9th day of December, 1904, the prosecuting attorney of Pemiscot county filed an information charging the defendant and one Luther Erankum with murder in the first degree. At the July term, 1905, the case was dismissed as to Frankum and *540the defendant was tried and convicted of murder in the second degree, and his punishment assessed at thirty years in the penitentiary. After taking the proper steps he appealed the cause to this court. .
