OPINION
VARNER, District Judge.
This cause is now before the Court on an appeal of a bankruptcy Order issued by Hon. A. Pope Gordon, United States Bankruptcy Judge for the Middle District of Alabama.
The facts in this case are relatively straightforward and undisputed. On October 7, 1985, the Debtors herein, John Rio, Jr. and his wife, Avelina M. Rio, filed a petition under Chapter 13 of the Bankruptcy Code.
