Childs v. United States

District of Columbia Court of Appeals

Decided October 12, 2000No. 00-CO-52PublishedCited by 10 opinions

1Per curiam

Appellant Jamal Childs challenges the trial court’s denial of his motion to dismiss a felony murder charge on double jeopardy grounds. He contends that since he was convicted of the lesser included offense of armed robbery in his first trial, the Double Jeopardy Clause of the Constitution of the United States precludes his retrial on the charge of felony murder. 1 Relying upon our recent decision in United States v. Allen, 755 A.2d 402 (D.C.2000), which we conclude is indistinguishable from this case, we affirm the judgment of the trial court.
