FACTS
On January 14, 2009, appellant was arrested for driving under the influence of alcohol (DUI) and driving with a blood-alcohol content of 0.08 percent or greater, in violation of subdivisions (a) and (b) of Vehicle Code section 23152. The notice to appear indicates that after being arrested, appellant was cited and released pursuant to Penal Code section 853.6, subdivision (a)(1), due to the unavailability of a magistrate.
