We are concerned here with a petition to establish a report in an action of contract and tort which was tried before a justice of this court. For reasons hereinafter stated, the petition is denied.

In the basic action, the present petitioner sued the owner of a motor vehicle and sought to recover in one count for the value of labor and materials allegedly furnished in repairs to the motor vehicle, and in a second count for the alleged conversion by the defendant-owner of the said vehicle on which the plaintiff claimed a garage-man’s lien.
