This is an action of jactitation or slander of title, the plaintiff alleging possession of and a legal title to the land in controversy; and the defendants justifying under a superior title, and also alleging possession of parts of the territory which is alleged to be covered by and included in the calls of the plaintiff’s patent — each party alleging the slander of the other’s titles and claiming damages of the other.
