The defendant .was convicted of murder, without recommendation, and to the order of the court denying him a new trial he excepted. ■ One of the grounds of the motion for a new trial is as follows:, “The court erred in not granting movant a continuance upon motion made at the call of said case and before pleading to the merits, the motion for continuance being as follows: A.
