The defendant was indicted for the crime of murder, and convicted of voluntary manslaughter. He made a motion for a new trial, which being overruled, he excepted.

A written motion was submitted by the defendant, requesting the court to continue the case for the term or at least postpone the trial to some future day, in order to allow him an opportunity to-obtain the testimony of a material witness.
