This case comes before us on petition for review granted December 18, 1951, pursuant to the provisions of the Uniform Code of Military Justice, Article 67 (b) (3), 50 USC § 654. On May 28, 1951, the accused, Ferretti, a member of the United States Marine Corps, was tried by general court-martial convened at the United States Naval Base, Charleston, South Carolina,. on a charge of desertion in violation of Article 8, paragraph 21, Articles for the Government of the Navy, 34 USC § 1200.
