Thompson filed a bill in equity against Moses Thompson, alleging substantially that on March 17, 1854, plaintiff, defendant, J ames M. Thompson and James Irvin, trading under the firm name of Trvin & Thompson, had purchased as tenants in common a certain Martha Furnace property; tbat on November 16, 1857, they bad agreed to dissolve the copartnership and the defendant, with James M.
