Appeals (1) from a judgment of the County Court of Albany County (Breslin, J.), rendered February 21, 1997, upon a verdict convicting defendant of the crimes of assault in the first degree (two counts) and criminal possession of a weapon in the second degree, and (2) by permission, from an order of said court, entered January 30, 2001, which denied defendant’s motion pursuant to CPL 440.20 to set aside the sentence, without a hearing.
