Reversing.

Joyd Hatton was convicted of the crime of housebreaking and sentenced to a term of two years in the penitentiary.

As grounds for reversal, he urges that the trial, court erred in failing to instruct the. jury to find a verdict in his favor at the conclusion of the commonwealth’s evidence and that the court further erred in orally instructing the jury.
