I. INTRODUCTION.
On May 8, 2002, this court granted in part and denied in part a motion to dismiss (“Order”), 299 F.Supp.2d 1090, 2002 WL 32346742. The court found that Plaintiffs had taxpayer standing to assert equal protection challenges to the provision of benefits (“Benefits”) by the Office of Hawaiian Affairs (“OHA”), the Department of Hawaiian Home Lands (“DHHL”), and the Hawaiian Homes Commission (“HHC”) to Hawaiians and to native Hawaiians.
