HIGGINS, Justice.
The insured instituted an action against his insurer to recover a premium paid under protest and three' disability payments of $250 each, alleged to be due him, under the provisions of an insurance policy, on June 15, July 15 and August 15, 1939, with legal interest thereon, and also prayed for penalties of double indemnity, and attorney’s fees, under Act 310 of 1910. The defendant admitted the issuance of the policy and averred that it had paid the plaintiff the sum of $250 per month disability from September 15, 1931, until June 15, 1939, and stopped further payments…
