delivered the opinion of the court: Defendant has appealed the judgment entered on a jury verdict of *1250 in a trial for an assault committed upon the person of the plaintiff.

Although briefs have been filed by both parties, we do not reach the merits of the appeal. The plaintiff has filed a motion to dismiss the appeal which we have ordered taken with the case. The basis of this motion is the appellant’s failure to timely file the report of proceedings and to timely file the record on appeal under the provisions of Supreme Court Rules 323 and 326 respectively.
