The only state constitution which has a provision concerning the liability of stockholders exactly like that of Idaho is that of Missouri, as amended in 1870. As our court has never construed the constitution of Idaho, it becomes of prime importance to examine the construction given the Missouri constitution by the courts of that state.…

The facts in this case are stipulated and in substance are as follows:
The respondent, the Basin Mining Company, Ltd., is and, during all the times mentioned in this controversy, was a corporation organized under the laws of the state of Idaho. The respondent was organized with a capital of $1,500,000, divided into 1,500,000 shares of the par value of one dollar *318each; that all of said stock was upon the organization of the company transferred and delivered to the owners of certain mining property in full payment for the mining property conveyed to the corporation, and the property was accepted…
