Defendant, Richard E Conti, charged with a violation of section 64-3 (B) of the Code of the City of Dunkirk, has moved for an order dismissing the information pursuant to CPL 170.35 (1) (a) on the ground that the information is not sufficient on its face; dismissing the information pursuant to CPL 170.35 (1) (c) on the ground that the ordinance is unconstitutionally vague as applied to defendant; and, in the alternative, should the court deny the dismissal applications, suppression of any and all statements attributed to defendant on the ground- that the…
