This matter came before the Court on the Defendant’s Plea in Bar to Plaintiffs’ Fourth Amended Complaint. The Plea relates only to Count IV, Plaintiffs breach of contract claim, which is the only claim to have survived the Defendant’s most recent demurrer. After hearing evidence and argument presented by both parties on Wednesday, October 26, 2011, the Court took the matter under advisement.
