The case of The People ex rel. Ellis agt. Flagg (15 How. Pr. Rep., 553), relied upon by the respondent, does not sufficiently maintain the proposition that, under the statute of 1870, chapter 190, Laws of 1870, the comptroller has a revisory power over, or concurrent power with, the board of supervisors in auditing and allowing claims against the county. It is true that the statute therein considered is identically the same as that of 1870, but that adjudication must be regarded as intended to apply to the facts disclosed only.
