This was an action for injunction, arising under a construction of the city charter of the city of Indianapolis. The assignment of errors presents for consideration the correctness of the court’s rulings in sustaining the several demurrers of appellees to the appellant’s amended complaint.

From the complaint it appears that on the 11th day, of May, 1894, the board of public works of the city of *124Indianapolis adopted a resolution for the improvement of a part of West Washington street in said city, upon which appellant’s real estate is situated, “by grading and curbing, and paving the roadway…
