This case raises the question of what constitutes “cause” for the purpose of dismissing a petition under Chapter 13 of the Federal Bankruptcy Code. The appellant, Ernest R. Lilley, Jr., filed a petition under Chapter 13 of the Federal Bankruptcy Act, 11 U.S.C. § 101 et seq., to discharge a debt incurred as a result of his willful failure to pay personal income taxes over a period of several years.
