In a suit in the district court of Dallas county, appellee was awarded a judgment in the sum of $2,872.43 against appellant, and this judgment and the matters involved therein are duly brought before this court for review.

Appellant caused to be constructed what is known as the Circle Theater building in the city of Dallas. Appellee was awarded the contract for the construction of the stone work, brick work, cement work, stage joists, first and second floor joists, ceiling joists, and shiplap for roof.
