On June 21, 1934, Western Fire Insurance Company filed its bill of interpleader against R. R. Atwell and Jessie C. Atwell and the First Bank & Trust Company of Pensacola.

The bill alleged in substance that plaintiff on July 12, 1932, by policy No. F-72441, insured for a term of three years the dwelling of R. R. Atwell; that on or about July 24, 1932, The First Bank & Trust Co. of Pensacola, claiming to act with authority and acquiescence of R. R. At-well, had plaintiff’s agent in Pensacola issue, conditioned on its' being endorsed on said policy, a mortgage clause making the loss under the…
