OPINION
APODACA, J.
{1} Defendant appeals a jury verdict and the .trial court’s judgment against him for the wrongful death of his patient (the patient). The wrongful death action was brought by Plaintiff as personal representative of the estate of the patient. Defendant argues that the trial court committed reversible error by prohibiting submission of his special verdict form on comparative negligence.
