This is an appeal from a district court decision dismissing the appellant Dave Buff-ington’s (Buffington) application for post-conviction relief as untimely. Three years after the district court relinquished jurisdiction in Buffington’s case, Buffington filed the application, alleging that his procedural due process rights were violated during the jurisdic*508tional review process at the North Idaho Correctional Institution (NICI).
