Appellee alleges in his complaint that he is the owner of the real estate therein described; that the appellants .have issued an execution upon a judgment rendered against David L. Dunn, and threatened to levy it upon and sell appellee’s real estate to satisfy the judgment.
Appellants answered, admitting that on the 16th day of December, 1872, a judgment was obtained against David L. Dunn, and that they intend to seize and sell the real estate to satisfy the same, and averring that the judgment was rendered on a promissory note executed by the judgment debtor on the 4th day of February, 1868;…
