This is an action of trespass, brought in the court below by the appellee to recover of the appellant and ten others who were joined with it as defendants, damages for entering upon the lands of the plaintiff and removing therefrom a quantity of gravel, rock, stone, etc. At the return term of the court, the appellant presented its petition, which was sworn to, and bond for the removal of the cause to the federal court.
