This case turns upon the construction of the will *117of James E. Rothwell, late of Brookline, deceased. The respondent, who is the son of the testator, has appealed from the allowance of the petitioners’ first account as trustees under that will. There is only one disputed item, appearing as a payment in schedule “E” of the account. This item, however, comprises several sums representing the respondent’s one-third share of net income under paragraph “Seventh” of the will.
