The judgment involved in this appeal was entered in the district court -on the second day of *214March, 1911. On the same day appellant was allowed an appeal to the supreme court, conditioned upon his filing his appeal bond within ten days, and ninety days was given him within which to “prepare and tender” his bill of exceptions. The appeal bond was approved and filed in the district court on the eighth day of March.
