WILSON, Circuit Judge.

Prior to January 5, 19321, Gurnett & Co. conducted a stock brokerage business in Boston in the commonwealth of Massachusetts. The appellant was a margin customer. Dor some time prior thereto Gurnett & Co. carried on the appellant’s aeeount with it 500 shares of the preferred stock of the Massachusetts Utilities Associates, hereinafter referred to as the Utilities stock, and 78 shares of American Telephone & Telegraph Company stock, both of which stocks we understand were purchased on order of the appellant, and on aeeount of which there was due Gurnett & Co. on January…
