MICHIE, District Judge.
This case arises from a petition to review an order of the Referee with respect to the proceedings in the bankruptcy of one Martin Robert Romanac.
On March 5,1964 the petitioner, Allied Supply Company, a Virginia corporation, hereinafter referred to as Allied, filed a memorandum of mechanic’s lien in the amount of $2967.07 against a duplex house owned by the bankrupt in the City of Charlottesville. There is no question but that this filing perfected Allied’s lien Under applicable Virginia law. See Va. Code Ann. §§ 43-4 and 43-7 (repl. vol. 1953). Thereafter on April 24,…
