This case discloses the following facts : William H. Randall being the owner of certain lands in the city of St. Paul, did, on the 12th day of July, 1856, lease the same by deed to Defendants Langley and Scales, for the term of ten years, for certain stipulated rents. Which lease contained a clause forbidding the lessees to assign the lease, or underlet the premises, or any part thereof, without the written consent of the lessor.
